Affidavits are most useful when the petitioner’s evidence of a bona fide marriage is weak and possibly insufficient. What’s more, strong evidence of a bona fide marriage may help petitioners avoid the I-751 interview. The I-751 affidavit is not mandatory, but it’s strongly suggested by many attorneys.
